Order on Motion to Withdraw Order on Motion for Extension of Time to Set/Reset Deadlines
MINUTE ORDER: The 55 Motion of Cohen Seglias Pallas Greenhall & Furman, P.C., to Withdraw as Counsel for the Republic of Sierra Leone is GRANTED. Under Local Civil Rule 83.6(d), the court has discretion to deny a motion to withdraw without substitute counsel "if the withdrawal would unduly delay trial of the case, or be unfairly prejudicial to any party, or otherwise not be in the interest of justice." Plaintiff contends that withdrawal would unfairly prejudice it by sapping the momentum the parties have towards consummating the settlement agreement. Having conducted an in camera review of the materials provided by Cohen Seglias, the court does not believe that forcing Cohen Seglias to continue representation will facilitate consummation of the settlement. Therefore, permitting withdrawal will not prejudice Plaintiff. In addition, Defendant's 62 Motion for an Extension of Time is GRANTED in part and DENIED in part. To allow Defendant some additional time to obtain substitute counsel, Defendant shall have until 8/21/2026 to respond to Plaintiff's Second Set of Requests for Admission. Defendant is hereby WARNED that unanswered requests are deemed admitted by operation of law. See Fed. R. Civ. P. 36(a)(3). Defendant is further WARNED that failure to obtain substitute counsel and to participate in this litigation may result in the entry of default judgment and other consequences. Cohen Seglias is permitted to withdraw once it sends a copy of this order to Defendant. The Clerk of the Court shall also transmit a copy of this order to Defendant. Signed by Judge Tanya S.
