TEXT ORDER: Before the Court is Defendants' Motion to Vacate Entry of Default entered against them on September 3, 2026. ECF No. 9 . Under Fed. R. Civ. P. 55(c), "[t]he court may set aside an entry of default for good cause[.]" Defendants assert that the default was not willful and occurred "because Dr. Prosseda expected counsel for the Department of Health and Human Services [] to enter their appearance and defend against this action." ECF No. 9 at 1. Based on the nature of the Complaint, the lack of prejudice to Plaintiff, and Defendant Counsel's prompt request to vacate the default, the Court finds that good cause exists to vacate the Clerk's Entry of Default (ECF No. 7 ). Accordingly, the Motion (ECF No. 9 ) is GRANTED and the Clerk's Entry of Default is VACATED. So Ordered by District Judge Melissa R. DuBose on 9/30/2026. (Urizandi, Nissheneyra)
