Order
NOTATION ORDER: The Court STRIKES Defendant's Notice of Substitution 83 . If Defendant seeks to substitute the personal representative of the Estate of Wayne L. Willis pursuant to Federal Rule of Civil Procedure Rule 25, Defendant may file a properly supported motion to do so. Defendant must indicate in any such motion whether the substitution is opposed. Signed by Magistrate Judge S. Courter Shimeall on 7/23/2026. (wam)
Order on Motion for Miscellaneous Relief
NOTATION ORDER: In his Notice of Substitution of Counsel 82 , Attorney Rick Brunner seeks to substitute himself and Attorney Morgan L. McDermott as counsel of record for Attorney Patrick Quinn. However, Defendant's contemporaneously filed Notice 83 indicates that Attorney Quinn departed Attorney Brunner's firm prior to filing the instant Notice of Substitution. Accordingly, the Court construes the Notice of Substitution 82 as a motion to substitute and, so construed, the motion is GRANTED to the extent that Attorney Brunner and McDermott may appear as counsel of record for Defendant. If Attorney Quinn wishes to withdraw, he may file a motion to do so in conformity with S.D. Ohio Civ. R. 83.4(b). Further, all Defense counsel of record are DIRECTED to update their PACER accounts to reflect their current firm affiliations as soon as is practicable. Signed by Magistrate Judge S. Courter Shimeall on 7/23/2026. (wam)
