   MINUTE ORDER signed by Magistrate Judge Erin Guy Castillo on 7/10/2026: (Text Only Entry) In light of Plaintiff's representations to the Court, (Doc. 46), and the strong preference that cases be decided on the merits, see, e.g., Falk v. Allen, 739 F.2d 461, 463 (9th Cir. 1984); Westchester Fire Ins. Co. v. Mendez, 585 F.3d 1183, 1189 (9th Cir. 2009), the Order to Show Cause ("OSC"), (Doc. 46 ), is hereby DISCHARGED. The Court will provide one final opportunity for the parties to provide the Court with a Joint Scheduling report and otherwise comply with the Court's orders. This will be the parties' final opportunity to comply.

   In order to afford the parties adequate time to meet and confer and to prepare their report, the Scheduling Conference is RE-SET to September 8, 2026, at 9:30 AM before Magistrate Judge Erin Guy Castillo. The parties SHALL file their joint scheduling report by no later than seven (7) days before the Scheduling Conference. Again, all parties are reminded that if they fail to file a timely scheduling report or fail to appear at the scheduling conference on September 8, 2026 without good cause, the Court will issue sanctions on any and all counsel as well as any party or parties who cause non-compliance with this order.
