   (IN CHAMBERS) ORDER WITHDRAWING ORDER GRANTING PLAINTIFF'S APPLICATION TO FILE DOCUMENTS UNDER SEAL (DOC. NO. 44 ) DUE TO CLERICAL ERROR by Magistrate Judge Daniel S. Roberts. On September 10, 2026, Plaintiff refiled his Application to file portions of his Motion to Compel under seal and submitted with that Application a proposed Order. See Doc. No. 43 . Pursuant to Local Rule 79-5.2.2(b)(i), Defendant (as the Designating Party) was then required to "file a declaration establishing that all or part of the designated material is sealable, by showing good cause or demonstrating compelling reasons why the strong presumption of public access in civil cases should be overcome, with citations to the applicable legal standard" within four days of that Application. Prior to the due date for Defendant's Declaration, however, the "Proposed Order Granting Plaintiff's Application to File Documents Under Seal [L.R. 79-5]" that Plaintiff submitted with his Application was entered on the docket with the Magistrate Judge's typed signature. See Doc. No. 44 . Such entry was the result of a clerical error, as that Order was not authorized for filing. Such Order is therefore WITHDRAWN on that basis. Defendant shall have four days from the date of this Order to file the required Declaration establishing that the marked-confidential material Plaintiff seeks to file under seal is sealable, as required under Local Rule 79-5.2.2(b)(i). The Court will then rule on the Application and issue a new order either granting or denying the Application to file under seal. IT IS SO ORDERED. (lkr)
