Judge Mark G. Mastroianni: ELECTRONIC ORDER entered. Plaintiff filed 18 an amended complaint without leave of court and without indicating whether Defendant consented to the amendment. To date, no answer to the amended complaint has been filed. The parties subsequently filed a joint status report indicating that they have been conducting fact discovery and expect to complete it by October 31, 2026. Accordingly, on or before September 15, 2026, Plaintiff shall file a notice indicating whether Defendant consented to the filing of the amended complaint. Defendant shall also respond to the amended complaint by September 17, 2026, so that the court can schedule a Rule 16 conference to address the status of discovery and establish appropriate case-management deadlines.
