Order on Motion for Judgment under Rule 54(b)
TEXT ORDER: Before the Court is the Town of Johnston's Motion for Entry of Final Judgment on Count VI of the Amended Complaint. ECF No. 60 . The Court has reviewed the motion, the Plaintiffs' response in opposition, the Defendants' reply thereto, and the relevant case law. While the Court may exercise its discretion and allow a piecemeal appellate approach, the Court respects this Circuit's advice that "there is a long-settled and prudential policy against the scattershot disposition of litigation," and must follow the Circuit's instruction that "a district court should certify a judgment under Rule 54(b) only after it has determined that (i) the ruling in question is final and (ii) there is no persuasive reason for delay." Gonzlez Figueroa v. J.C. Penney Puerto Rico, Inc., 568 F.3d 313, 317 (1st Cir. 2009) (quoting and citing Spiegel v. Trs. of Tufts Coll., 843 F.2d 38, 42-43 (1st Cir. 1988)). There is no doubt that this Court has entered judgment as a matter of law on Count VI of Plaintiffs' Amended Complaint. See ECF No. 54 . But the "similarity of [both] legal [and] factual issues" raised by the remaining claims "militates strongly against invocation of Rule 54(b)." Spiegel, 843 F.2d at 45. Therefore, the Court concludes that there is indeed a reason to delay the entry of partial final judgment on this single claim. The Town of Johnston's Motion is DENIED.
