MEMORANDUM OPINION AND ORDER that Defendants Motion to Dismiss (Dkt. 26) is GRANTED-IN-PART and DENIED-IN-PART. The Motion is granted as to Count II only with respect to Officer Edwards. The Motion is also granted with respect to Count IV. The Motion is otherwise denied; and it is FURTHER ORDERED that Count II is DISMISSED WITHOUT PREJUDICE as to Officer Edwards; and it is FURTHER ORDERED that Count IV is DISMISSED WITHOUT PREJUDICE; and it is FURTHER ORDERED that Plaintiffs have LEAVE TO AMEND and is DIRECTED to file any Amended Complaint within THIRTY (30) DAYS from the issuance of this Memorandum Opinion. Plaintiffs are warned, however, that if they fail to timely file an Amended Complaint, the Court will assume that they are electing to proceed only as to those Defendants who have answered and as to Officers Ogunlana and Dean on Count II.
