TEXT Minute Entry for Telephone Pretrial Status Conference held on 7/8/2026 before U.S. District Judge Mae A. D'Agostino: Appearances by Andrew Jayne, Esq. for plaintiffs; Robert Alessi, Esq., Courtney Saleski, Esq., Steven Rosato, Esq., and M. David Josefocits, Esq. for defendant Pioneer Bancorp.; Roland Garcia, Esq., Cynthia Neidl, Esq., and Kendyl Hanks, Esq. for Intervenor plaintiff National Payment Corp.; Judge D'Agostino addresses counsel regarding the reassignment of this case for trial from Judge Scullin to Judge D'Agostino.The trial is expected to last 4-5 weeks. Counsel agree to a FIRM trial date starting on Monday, September 28, 2026 at 9:30 a.m. in ALBANY; Pretrial Submissions and Motions in Limine are due by 9/8/26; Responses, if any, to motions in limine due by 9/15/26. Counsel request leave to file oversized briefs in support of their motions in limine - the request is GRANTED. Briefs, not to exceed 45-pages, are permitted; Judge D'Agostino directs counsel to email Expert Disclosure Responses and Expert Deposition Transcripts, as well as designations and objections to designations to the Court on or before 8/31/26. The Expert disclosures and deposition transcripts can be emailed to Judge D'Agostino's Courtroom Deputy Britney Norton. Designations and objections to designations can also be emailed to Judge D'Agostino's Courtroom Deputy. The Parties will meet and confer regarding the various entities on the case docket that have not yet appeared (i.e.HireFlux, etc.) - a status report will be provided to the Court in 1-week (7/15/26); Judge D'Agostino discusses expectations for trial. Civility, objections to testimony, Jury selection, voir dire, scheduling, evidence (ALL electronic evidence), and witness availability is discussed. The parties are encouraged to discuss all evidence before trial and be prepared to stipulate to any evidence which can be stipulated to. Counsel should be prepared to work a full-day each day and witnesses should be available and ready to go. Counsel are further advised that testimony should not be repetitive or redundant. Judge D'Agostino informs counsel that she will send questionnaires to the jury panel in this case - it will be a basic questionnaire which informs the potential jurors of the length of trial, names of parties, and basic employment, business, and knowledge of the case questions.
