STIPULATION AND ORDER OF VOLUNTARY DISMISSAL OF PLAINTIFF ANTHONY PALIE: NOW, THEREFORE, IT IS HEREBY STIPULATED AND AGREED, by and among the undersigned counsel for all parties who have appeared in this action, pursuant to Rules 21 and 41(a)(1)(A)(ii) of the Federal Rules of Civil Procedure, that: 1. The individual claims of Plaintiff Anthony Palie against all Defendants are hereby dismissed without prejudice, and Anthony Palie is dropped as a named Plaintiff from this action. 2. This dismissal is without prejudice to (a) the claims of the remaining named Plaintiffs and the putative class, and (b) Palie's rights, if any, as an absent member of any class that may hereafter be certified in this action. 3. Nothing in this Stipulation disturbs the stay entered by the Court; the stay remains in full force and effect as to all remaining parties and claims. 4. Nothing in this Stipulation prevents the remaining Plaintiffs from introducing testimony from Anthony Palie, whether live or through an affidavit; however, if Plaintiffs choose to do so, Defendants would be entitled to compel his attendance at a deposition. Each party shall bear its own attorneys' fees, costs, and expenses in connection with the claims dismissed by this Stipulation. 6. The Clerk of Court is respectfully directed to terminate Anthony Palie as a party to this action. This Stipulation does not otherwise affect the claims of the remaining plaintiffs, which shall continue in all respects. SO ORDERED. (Signed by Magistrate Judge Jennifer E.
