Order on Motion for Clarification
Judge Richard G. Stearns: ELECTRONIC ORDER entered granting 294 Motion for Clarification and finding that the STAY remains in place until the Bankruptcy matter regarding the financial and ownership interests asserted in this case is concluded.Plaintiff Gary Bloom asks the court for clarification regarding the automatic stay in this case entered on May 27, 2026. Bloom asked the Bankruptcy Court for a similar clarification representing that, when the stay was entered, Bloom was in the process of seeking to "add six non-debtors as defendants and to obtain a ruling regarding his objection to Magistrate Judge Boal's April 3, 2026 Order (the court notes that Magistrate Judge Boal denied the request to add nonparties to the litigation as filed seven months after the pretrial schedule deadline for adding parties and three months after the expiration of fact discovery citing undue delay). Bloom bases his motion on a general ruling from the Bankruptcy Court that, to the extent Blooms claims in this case is not prohibited by §§ 362(a) or 1301(a), he can proceed. In his Amended Complaint, Bloom specifically claims rights to financial and ownership interests in assets of defendant William Campbell III (the Debtor). The Automatic Stay statute, 11 U.S.C. § 362(a), freezes "(3) any act to obtain possession of property of the estate or of property from the estate or to exercise control over property of the estate; *** (6) any act to collect, assess, or recover a claim against the debtor that arose before the commencement of the case under this title...." As the Bankruptcy Court advised Bloom, "[t]he automatic stay 'is designed to effect an immediate freeze of the status quo by precluding and nullifying post-petition actions... in nonbankruptcy fora against the debtor or affecting the property of the estate.'" Hillis Motors, Inc. v. Hawaii Auto Dealers' Ass'n, 997 F.2d 581, 585 (9th Cir. 1993).This action remains STAYED until the Bankruptcy matter as applies to this case is concluded.
