    Text Order ~Util - Set Hearings

    TEXT ORDER-- The Court is in receipt of the parties' joint letter regarding outstanding discovery disputes. (ECF No. 50). Plaintiff's counsel shall provide Defense counsel with the last known contact information (address and telephone number) of Kimberly Price, Sarah Ghiya, Carl DiLeo and Dondre Oliver by October 14, 2026 or Defendant is granted leave to file a motion for appropriate sanctions, i.e. to bar these witnesses from testifying at trial. With regard to Plaintiff's communications with Kimberly Price, which Plaintiff now claims are "no longer on his phone," by October 16, 2026, Plaintiff shall provide Defendant with a sworn certification setting forth the date that the communications on the phone were destroyed/deleted, the reason for the destruction/deletion and what efforts were made to recover these communications. Further, by October 21, 2026, Plaintiff shall turn over his phone to a forensic expert retained by Defendant to make a forensic image for the purposes of determining whether any communications between Plaintiff and Ms. Price can be recovered and extracted. The number of depositions that Plaintiff is permitted to take is limited to 10, as set forth in the Initial Scheduling Order. Plaintiff has not made any application to the Court to increase this number to 19, and the Court will not entertain any such requests until Plaintiff completes the first 10 depositions, at which time he may make an appropriate application to the Court setting forth why additional depositions are needed. The deadline for the completion of fact discovery shall remain December 11, 2026. The parties shall abide by the already-extended deadlines set forth in the Court's September 2, 2026 text order. (ECF No. 45). There shall be a status conference before Magistrate Judge Adams on November 2, 2026 at 10:00 a.m. Microsoft Teams login credentials will be provided. The parties shall file a joint status letter, no longer than three (3) pages in length, no later than five (5) business days before the conference. This status letter shall set forth FIRM DEADLINES for all remaining fact depositions to be completed before the October 7, 2026 deadline, which the Court intends to "So Order." In light of this earlier status conference, the December 11, 2026 status conference is cancelled. So Ordered by Magistrate Judge Stacey D. Adams on 10/7/2026. (JB)
