The Court orders as follows: (1) The parties' request to postpone the start of trial is granted. The jury trial scheduled in this matter will begin on Monday, April 29, 2024, with jury selection to begin that day. (2) The Court defers ruling on Plaintiff's motion for leave to present Rebecca Smith by remote testimony at trial. Dkt. Nos. 526, 527. Plaintiff is directed to submit a letter by April 19, 2024, that (1) explains the nature of any legal restrictions that govern the remote testimony of Ms. Smith from Australia and (2) provides the name of the platform Plaintiff expects to use if Ms. Smith is permitted to testify remotely.(3) Plaintiff's request to file an unredacted copy of the supporting materials for Plaintiff's motion for leave to present Rebecca Smith by remote testimony is granted. Plaintiff's submission at Dkt. No. 527 shall remain under seal.(4) Plaintiff's request to present the deposition testimony of Kristen Visbal organized bytopic rather than in chronological order is granted. In order to assure the fair presentation of evidence, the Court will permit Plaintiff to organize the presentation of deposition testimony by topic area, subject to the following restrictions. Within each topic area, the witness's testimony must be presented in the chronological order in which it was delivered. Moreover, any video presentation of the deposition testimony should clearly indicate the date and time on which the deposition was taken so that the jurors can see where counsel has made the editorial decisions to splice together testimony from disparate dates and times during the deposition. The Court understands that Plaintiff will not introduce any topic with a visual aid. For the avoidance of doubt, Defendant may raise any specific objections to Plaintiff's presentation of Ms. Visbals deposition for the Courts consideration.(5) Parties are directed to submit revised proposed jury charges by April 23, 2024.(6) Plaintiff's fifth and thirteenth motions in limine, Dkt.
