Order on Motion for Reconsideration
ORDER denying 48 Motion for Reconsideration.
The Court DENIES the motion for recusal, and then the motion for reconsideration. As to the motion for recusal, Mr. Amelio still had not identified an extrajudicial basis for recusal. As to his fifth motion for reconsideration, he still fails to "point to controlling decisions or data that the court overlooked — matters, in other words, that might reasonably be expected to alter the conclusion reached by the court." Shrader v. CSX Transp., Inc., 70 F.3d 255, 257 (2d Cir. 1995).
In accordance with the Court's previous ruling, ECF No. 46 , the Clerk of Court nonetheless is respectfully directed to return ECF Nos. 47 and 48 , as well as the filings in ECF Nos. 49 , 50 , 51 , 52 , and 53 , to Mr. Amelio.
