ORDER. The Court is in receipt of the parties' 28 Notice of Settlement. The parties informed the Court that they anticipate needing 90 days to file their dispositional documents. All dates and deadlines, including the trial scheduled for November 2, 2026, are VACATED. The parties shall file their notice of dismissal by October 13, 2026. The Court sets a compliance hearing regarding dismissal for October 27, 2026 at 09:00 AM in San Jose, Courtroom 3, 5th Floor.
If the case is not dismissed by October 13, 2026, the compliance hearing will be converted into an order to show cause why the case should not be dismissed. If any party opposes the order to show cause, that party must file their objection in writing by October 20, 2026. Counsel must appear at the hearing in person; no remote appearances will be permitted.
