TEXT ORDER re 49 RESPONSE TO LETTER BRIEF filed by Capital City Gospel Mission re 47 Pre-Motion Letter for City of Albany: The Court is in receipt of the 47 Defendant's pre-motion request for leave to file a motion to dismiss, filed on August 14, 2026, and the 49 Plaintiff's response in opposition. On August 17, 2026, the Court Granted the City of Albany Defendant's request for leave to file their motion on or before 9/11/26 [See Dkt. No. 48]. After the Court Order was entered on August 17, 2026, the Court received plaintiffs' opposition [Dkt. no. 49]. As plaintiff's counsel raises in their opposition letter, the defendant's pre-motion letter [Dkt. no. 47] is over the 3-page limit. Counsel for the defendant are advised that in the future, all submissions should adhere to the Court's individual rules and the local rules. Counsel are directed to the Court's individual rules of practice and are directed to familiarize themselves with the Court's rules. The Court accepts the defendant's pre-motion letter [Dkt. no. 47] as filed on 8/17/26. The Court's text order granting defendant's request for leave to file their motion remains unchanged. The plaintiff's request to reconsider 48 Text Order, is DENIED. All dispositive motions remain due by the deadline set in the Court's August 17, 2026 Text Order [Dkt. no. 48] - Motions due 9/11/26.
