Order on Motion to Enforce Judgment
ORDER granting 70 Petitioner Willian Mendoza Berg's Emergency Motion to Enforce Order for Return of Minor Child to Norway. Respondent Socorro Del Carmen Polanco Sandoval shall IMMEDIATELY surrender M.P.B. to Petitioner or to an adult representative designated by Petitioner in writing. Unless the United States Marshals Service directs otherwise, the surrender shall occur at a time and place coordinated by the Marshals Service and no later than 5:00 p.m. on September 21, 2026. At the time of surrender, Respondent shall deliver to Petitioner, his designated representative, or his counsel every passport and other travel document issued to or for M.P.B. that is in Respondent's possession, custody, or control. The United States Marshals Service is AUTHORIZED AND DIRECTED to use lawful and reasonable measures to locate and recover M.P.B., take physical custody of him if Respondent does not surrender him as directed, and deliver him and his travel documents to Petitioner or Petitioner's designated adult representative. Respondent shall not remove M.P.B. from the Middle District of Florida, conceal his location, or interfere with his surrender. Petitioner shall arrange for M.P.B.'s prompt return to Norway and shall file a notice confirming the child's arrival in Norway within three days after arrival. Respondent is cautioned that failure to comply with this Order may result in contempt proceedings or other appropriate sanctions. The Clerk of Court is DIRECTED to close the file. ENDORSED ORDER re 70 Petitioner's Emergency Motion to Enforce Order for Return of Minor Child to Norway. The aforementioned 70 Motion includes the names of Petitioner's minor children in violation of Federal Rule of Civil Procedure 5.2(a), which states that a party making a filing that includes "the name of an individual known to be a minor...may include only the minor's initials." Fed. R. Civ. P. 5.2(a)(3). Accordingly, upon consideration of the circumstances and in an abundance of caution, the Clerk of Court is DIRECTED to seal the 70 Motion. Signed by Judge Paul G.
