NOTICE: Attorney Action Required to 229 Motion for Entry of Clerks Default. Attorney Jeffrey Labovitch advised that the Plaintiff filed a proposed "Default" order in an effort to have the Clerk of Court enter default against Christian Morimando, Tyler Deilmann, Blain Jones, Jesce Richt, Andrea Prokova, John Kurhanewicz, Rudy Morales, Shelby Kurhanewicz, Peter Anthony Arambula, and Nathan Vincelette. But as the Ninth Circuit Court of Appeals explained in Eitel v. McCool, 782 F.2d 1470, 1471 (9th Cir. 1986), a party's failure to plead or otherwise defend must be "shown by affidavit or otherwise" before the Clerk can "enter the party's default." Fed. R. Civ. P. 55(a). Furthermore, this district's Local Rule 7-2 requires requests for court action to be made in a motion "supported by a memorandum of points and authorities." So it's not enough to just file a proposed default order 17 entitled Motion for Entry of Clerks Default; a plaintiff who wants the Clerk of Court to enter default against a non-responding defendant must file a memorandum of points and authorities with exhibits that demonstrate that the defendant has failed to plead or otherwise defend. See LR 7-2. Counsel is therefore requested to correctly file a motion for entry of clerks default. (no image attached) (WJ)
