ORDER: On May 15, 2026, the Court directed the parties to submit ex parte settlement letters to Judge Marutollo's chambers via email (marutollo_chambers@nyed.uscourts.gov) by June 12, 2026 at 5:00 p.m. Defendant IPS Plumbing Corp. has filed a settlement demand letter, and failed to submit the requisite ex parte settlement letter by email.
By June 17, 2026, Defendant IPS Plumbing Corp. shall submit ex parte settlement letter to Judge Marutollo's chambers via email (marutollo_chambers@nyed.uscourts.gov) by June 17, 2026 at 5:00 p.m.
Pursuant to the undersigned's Individual Practice and Rule IV(C)(2), the ex parte settlement letters should include the following: (a) the communicated demand or offer as prescribed in Rule IV.C.1 above; (b) the strengths and weakness of their case; and (c) any legal arguments in support of their settlement position with citations to relevant authorities. As these ex parte statements will be treated as confidential and will not be docketed, they should include a realistic assessment of the partys settlement position.
