ORDER: IT IS ORDERED that Plaintiff's Motion for Reconsideration re: Equitable Estoppel (Doc. 1220 ) is denied. IT IS FURTHER ORDERED that Plaintiff's Motion for Reconsideration re: Compensatory Damages (Doc. 1222 ) is partiall y granted. Plaintiff may seek nonincarceration- based compensatory damages at trial, and he may testify regarding the emotional impact of his 1972 conviction and sentence and the emotional impact of the alleged constitutional violations affecti ng his original trial proceedings, so long as he does not testify regarding the emotional impact of his incarceration. Plaintiff may also present fact witness testimony from Lindsay Herf, Lesley Hoyt-Croft, and Jeanette Mare regarding their observations of Plaintiff. If Defendants seek to depose Herf, Hoyt-Croft, and Mare before trial, they may do so at Plaintiff's expense. Signed by Judge Rosemary Marquez on 08/06/2026.
