Order ~Util - Set/Reset Deadlines
TEXT ORDER: Per the Court's July 2, 2026 Text Order, this matter is set for an evidentiary hearing on August 4, 2026. The purpose of the hearing is to provide both parties the opportunity to present evidence relevant to Plaintiff's 85 motion, which seeks to establish a termination date for the consent decree that was entered in this case on November 1, 2022. The hearing is also intended to aid the Court in its resolution of Plaintiff's 98 motion to enforce the consent decree and 99 motion to appoint an independent monitor. To facilitate an efficient and orderly hearing, the parties are hereby ORDERED to jointly submit a pre-hearing memorandum on or by July 23, 2026. The memorandum should set forth (1) the witnesses that each party intends to call, if any; (2) the evidence that each party intends to submit; and (3) the order in which the parties intend to present evidence. The parties should make their best efforts to limit their presentation of evidence to only matters that are directly relevant to the Court's determination of the consent decree's termination date.
