Order on Motion for Extension of Time Order on Motion for TRO Order on Motion for Preliminary Injunction
ORDER denying 28 Motion for Extension of Time and dismissing this action.
Extension of Time. Plaintiff’s 28 Motion for Extension of Time fails to demonstrate good cause, as required by Rule 6(b) of the Federal Rules of Civil Procedure, fails to comply with Rule 7(b) of the Local Rules of Civil Procedure, and does not state “extraordinary circumstances” warranting another extension of time, as required by the Court in its order at ECF No. 27. Accordingly, Plaintiff’s 28 Motion for Extension of Time is denied.
Dismissal. The case is dismissed without prejudice for failure to effectuate service. Pursuant to Rule 4(m) of the Federal Rules of Civil Procedure, “[i]f a defendant is not served within 90 days after the complaint is filed, the court—on motion or on its own after notice to the plaintiff—must dismiss the action without prejudice against that defendant or order that service be made within a specified time.” Fed. R. Civ. P. 4(m).
This matter was filed on March 31, 2026, and Plaintiff failed to effectuate service within 90 days. The Court extended the deadline sua sponte to July 21, 2026, and notified Plaintiff that the action would be dismissed if she failed to effectuate service by that date. See ECF No. 25. The Court then extended this deadline to August 4, 2026, upon Plaintiff’s motion. See ECF No. 27. Instead of filing the proof of service by August 4, 2026, Plaintiff filed yet another motion to continue. The Court denied that motion to continue above.
Accordingly, this matter is dismissed without prejudice pursuant to Rule 4(m) of the Federal Rules of Civil Procedure. All outstanding motions are denied as moot. The Clerk is respectfully directed to close this case.
