Electronic Clerk's Notes for proceedings held before Chief District Judge Denise J. Casper: Status Conference held on 9/16/2026. The Court has colloquy with counsel regarding completed and outstanding deposition. Where the deposition of Non-Party Matthew Capobianco took place yesterday 9/15/2026, the Court notes that it ALLOWS D. 295 STIPULATION and Proposed Order to Allow Deposition of Non-Party Matthew Capobianco nunc pro tunc. As to the outstanding deposition of Tony Tannoury, M.D., the Court will allow that deposition to go forward on a mutually convenient date though it is otherwise outside of the discovery time. The date for the rescheduled deposition is to be decided jointly by counsel. Parties provide further case status and discuss possible change to the sequencing of discovery events. The Court maintains previously set schedule. However, counsel for both parties may confer and can file a joint notice proposing an alternative schedule for expert disclosures. Defendant anticipates the filing of summary judgment motions. Hearing on any motions for summary judgment is set for 5/5/2027 at 2:00PM. If no summary judgment motions are filed, hearing will be converted to an initial pretrial conference. The parties shall confer regarding the topics identified under Local Rule 16.5(d) and shall prepare and submit a joint pretrial memorandum in accordance with Local Rule 16.5(d) no later than five (5) business days prior to the pretrial conference. The pretrial memorandum shall also propose deadlines for the filing of motions in limine, proposed jury instructions, proposed voir dire and a proposed trial date.
