TEXT ORDER entered by U.S. District Judge Sue E. Myerscough on 8/26/2026. On August 20, 2026, the parties filed a Joint Stipulation of Dismissal (d/e 57 ) pursuant to a Confidential Settlement Agreement and Limited Release. As the Parties requested that the Court retain jurisdiction to enforce the Settlement Agreements, the Court directed that the Settlement Agreements be filed under Seal for the Court's review (d/e 58 ). On August 24, 2026, as directed, the Settlement Agreements were filed under Seal with this Court (d/e 59 ). The Joint Stipulation of Dismissal (d/e 57 ) states that the parties request that this Court retain jurisdiction over the Parties and the Settlement Agreements for the purpose of enforcing the terms, including without limitation, the enforcement provisions set forth in the Settlement Agreements. Federal Rule of Civil Procedure 41(a)(1)(A)(ii) states that a plaintiff "may dismiss an action without a court order by filing... a stipulation of dismissal signed by all parties who have appeared." Both Plaintiff and Defendants, through their respective representatives, have signed the filed Joint Stipulation of Dismissal (d/e 57 ). This case has been dismissed with prejudice. As requested by the Parties, this Court retains jurisdiction to enforce the Settlement Agreements. All pending deadlines and settings are VACATED. No judgment to enter. Each party to bear its own attorneys' fees and costs in connection with this Joint Stipulation of Dismissal (d/e 57 ). This case is closed.(BMG)
