Order on Motion to Stay Order on Motion for Protective Order 1 - Terminate Deadlines and Hearings
ORDER. The motion to stay discovery at ECF No. ECF No. 37 is denied. Defendants moved for a stay of this case based on the Rule 12(c) motion and concerns about a parallel criminal investigation. The pendency of the motion is not a sufficient reason to stay discovery. The parties should be in a better position to resolve this case if they exchange discovery as to the merits and defenses of the case. As to the possibility of a pending criminal investigation, none of the attorneys have been able to confirm that there is an investigation underway, including during the 7/9/2026 conference. Given the lack of a persuasive reason for the Court to enter a stay, the motion is denied.
The protective order at ECF No. 45 -1 is so-ordered with the following modifications: as to paragraph 10, the receipt into evidence of any material will be determined by the trial judge. Nothing in this Order restrains that judge's authority. As to paragraph 11, notwithstanding the provisions of this paragraph, each side may keep one complete set of all discovery materials so that counsel can comply with their ethical obligations.
As discussed during the conference, the motion to withdraw as counsel at ECF No. 53 is stayed until the completion of mediation.
