ORDER denying the 16 Motion for Leave to File First Supplemental and Amended Complaint, filed by Plaintiff Chloe Richard. While the 16 Motion is timely filed and unopposed, and good cause may exist for Plaintiff to amend her Complaint to add as a defendant the alleged lessor/operator of the premises where she fell, OM Scenic Highway Baton Rouge Oil LLC ("OM Scenic"), the [16-2] proposed First Supplemental and Amended Complaint fails to properly identify the citizenship of OM Scenic. The citizenship of a limited liability company is determined by the citizenship of all its members, each of which must be specifically identified by name. Nunez v. ACE Am. Ins. Co., No. 17-1593, 2017 WL 6997341, at *4 (M.D. La. Dec. 28, 2017), report and recommendation adopted, No. 17-1593, 2018 WL 493398 (M.D. La. Jan. 16, 2018). Negative allegations of citizenship, i.e., "a citizen of a state other than Louisiana," are insufficient. Truxillo v. American Zurich Ins. Co., No. 16-369, 2016 WL 6987127, at *6 (M.D. La. Oct. 24, 2016). The Court is alleged to have diversity subject matter jurisdiction over this action. Plaintiff is alleged to be an LA citizen and Defendants Scenic Highway Center LLC ad P.C. Petroleum Company, LLC are alleged to be FL citizens in the 1 Notice of Removal. The Petition also aleges that the damages exceed the amount required for federal diversity jurisdiction. R. Doc. 1-2, p. 4. The citizenship of OM Scenic is required so that the Court can make the determination required under 28 U.S.C. 1447(e). The denial is without prejudice to Plaintiff refiling a motion for leave that has attached a comprehensive, amended Complaint that adequately identifies the citizenship of OM Scenic.
