MINUTE entry before the Honorable Matthew F. Kennelly: Video status hearing held on 7/2/2026. Plaintiffs' motion to file under seal 521 is granted. Oral argument heard on various disputed matters. As more fully explained on the record: (1) The relators Kristine Cooper and Scott Millard's motion to quash the subpoenas in their entirety 512 is denied. However the Court made certain modifications to the scope of the subpoenas and questioning. The parties are to consult the transcript for those rulings but may prepare and submit by 7/7/2026 a proposed case management order governing the depositions if they wish. Documents withheld by relators relating to plants other than Sturgis are to be logged in a way similar to a privilege log. Documents responsive to the subpoenas are to be produced initially (and promptly) to Abbott which may review them (also promptly) for privilege claims. Any documents over which Abbott claims a privilege in whole or in part are to be logged. The depositions of the relators are limited to 10 hours for each relator to be split as follows: 5 hours for all plaintiffs and 5 hours for all defendants. (2) Abbott's motion for a protective order regarding marketing discovery (concerning two specific depositions) 513 is denied. (3) The parties are to further discuss the sequencing of expert reports and Rule 35 examinations consistent with the Court's comments during the hearing. A joint status report in this regard is to be filed on 7/13/2026. Any proposed draft order is to be sent to Judge Kennelly's proposed order email address in Word format. (4) Jury trial in the San Miguel member case is set for 11/8/2027 at 9:15 a.m. (5) The case is set for a further case management conference by video on 8/28/2026 at 10:00 a.m. The Court reserves the right to change the hearing to an in-person hearing.
