ORDER re 105 Notice of Suggestion of Mootness and 107 Response to Suggestion of Mootness. On 9/22/2026, Defendants Penn Cambria School District, Forest Hills School District, Greater Johnstown School District, Bedford Area School District, Somerset Area School District, and Westmont Hilltop School District (the "non-settlement Defendants"), filed a 105 suggestion of mootness. The suggestion of mootness contends that, in light of the settlement agreements Plaintiff has executed with various former Defendants in this case (the "settlement Defendants"), the controversy in this case has now become moot. In response, Plaintiff avers that this case has not become moot. See ECF No. 107. In light of the disagreement between Plaintiff and the non-settlement Defendants regarding whether this case has become moot, IT IS HEREBY ORDERED that the non-settlement Defendants shall file amended motion(s) to dismiss and supporting briefs that set forth all bases for dismissal the non-settlement Defendants wish to argue, including mootness, on or before 10/16/2026. Per the Court's Practices and Procedures, Defendants must confer with Plaintiffs prior to filing the amended motion(s) to dismiss and to include a certificate of conferral with the filing(s).
