Contempt Hearing

Defendant Shivo, through counsel, proffered several reasons for his failure to purge his contempt, including an allegedly overturned log truck. These reasons were not docketed nor conveyed to the Court. As noted on the record in open court today, Defendant Shivo did not provide the Court with any justification or demonstrate good cause for his noncompliance with its Order [ECF No. 27] prior to this hearing.
Defendant Shivo reported that the vehicle was scheduled to be delivered to Plaintiff within a half hour. In light of his history of failing to follow through on his representations to the Court and to comply with its orders, [see generally ECF No. 29], the Court ordered that Defendant Shivo be held in the custody of the U.S. Marshals Service until the vehicle is delivered. Defendant Shivo was remanded to the custody of the U.S. Marshals Service.
To ensure that the sanction is calculated to "coerce compliance rather than to punish past noncompliance," Hawkins v. Dep't of Health & Human Servs., 665 F.3d 25, 32 (1st Cir. 2012) (citing McComb v. Jacksonville Paper Co., 336 U.S. 187, 191 (1949)), the Court, through its Clerk, confirmed that Attorney Dombrowski had the ability and intended to coordinate with the individuals responsible for delivering the vehicle. Attorney Dombrowski further confirmed that he will remain in contact with those individuals until delivery is completed.
Pursuant to the Court's Order [ECF 31], Defendant's counsel notified the Court by email at 2:10pm today confirming that delivery of the vehicle was completed. The Court then instructed the U.S. Marshals to release Defendant Shivo from custody.
