The parties were heard on the August 26, 2026 Status Report, and the Court made rulings on the record.
The Court granted 205 Defendants Motion for Discovery for Issuance of Request for International Judicial Assistance. Defendants are directed to file a proposed order requesting that the French Ministry of Justice grant their Chapter II Request pertaining to Jean-Marc Golberg. Regardless of whether the French Ministry of Justice grants Defendants Chapter II request, Mr. Goldbergs deposition must proceed on September 18, 2026 or shortly thereafter.
The parties are directed to confer regarding Defendants privilege logs and the basis for withholding documents. If the parties are unable to resolve all privilege issues, they are granted leave to brief those issues.
Plaintiffs are directed to make complete, Bates-Stamped, and ESI-compliant productions at least five days prior to the depositions of witnesses for whom those productions are being made.
Plaintiffs are directed to respond to Defendants deficiency letters for depositions that have occurred.
The parties are reminded to conduct themselves with decorum and to ensure that all lawyers are properly trained to take depositions concerning sensitive witnesses.
The parties are directed to file a joint letter regarding proposed consolidation of cases and any expert discovery issues no later than September 14, 2026.
A status conference is scheduled for September 28, 2026 at 9:30 a.m. before Magistrate Judge Peggy Kuo by video. The parties are directed to file a joint status report no later than 5:00 pm on September 22, 2026, outlining the progress of discovery. If there are unresolved discovery issues that need to be raised at the September 28, 2026 Status Conference, the parties must clearly and succinctly set out their positions on each disputed issue in the joint status report.
The joint status reports are limited to a chart outlining the issues and two pages for each disputed issue. If the parties require judicial intervention prior to September 28, 2026 Status Conference, they are directed to file a two-page joint letter detailing their positions for each disputed issue and the degree to which the issue requires urgent attention.
Links to access these Zoom meetings will be provided to counsel separately. The parties are directed to log onto the platform at least 10 minutes before the start of the conference. Only counsel who have filed notices of appearances two business days before the conferences may appear on the record.
Any individuals wishing to participate by audio only, and in a non-speaking role, are directed to call toll free (571) 353-2301 and input the Access Code 143 712 808 at the time of the Conference.
