Order to Show Cause
ORDER: On January 2, 2025, Germane Hodge and Cynthia Romano ("Plaintiffs") brought this Action against Luis Zapata Arenas and Farmland Produce, LLC ("Defendants") in New York Supreme Court, Rockland County, alleging Plaintiffs were injured in an accident with Defendants' truck. (See Notice of Removal Ex. 1 (Dkt. No. 1).) On February 5, 2026, Defendants received a response to a discovery demand that they contend entitled them to remove this Action. (See Notice of Removal P 3.) They removed it to this Court on March 3, 2026. (Id.) There has been no docket activity in this case since it was removed, Plaintiffs have not filed a notice of appearance, and Plaintiffs did not appear at an initial conference scheduled for July 21, 2026. Accordingly, it is hereby: ORDERED that Plaintiffs shall show cause within fourteen days as to why this case should not be dismissed for failure to prosecute. See Armstrong v. Guccione, 470 F.3d 89, 103 n.1 (2d Cir. 2006) (noting that "a federal district court has the inherent power to dismiss a case sua sponte for failure to prosecute" (citing Link v. Wabash R.R. Co., 370 U.S. 626, 630-32 (1962)). The Court may dismiss this case without further notice in the event that good cause is not shown. SO ORDERED. (Signed by Judge Kenneth M. Karas on 7/21/2026) (ar)
