Order on Motion to Adjourn Conference Status Report Order 1 - Terminate Deadlines and Hearings
ORDER granting 12 Motion to Adjourn Conference. The 5/1/2024 Initial Conference is rescheduled for 5/15/2024 at 3:00 PM before Magistrate Judge Vera M. Scanlon. To gain access to the ZoomGov audio conferencing system, the parties are to dial 1-646-828-7666; enter meeting ID 16121901090 and press the pound key; when asked for a participant ID, press the pound key; and enter passcode 091622 and press the pound key. On or before 5/8/2024, the parties are to complete and file the Joint Proposed Civil Case Management Plan at ECF No. 8 .
Counsel are expected to work to resolve the issues related to representation such that the docket is updated and accurate. As to all Plaintiffs, Mila Niki Andreou, who signed the complaint in the state court action, see ECF No. 1 -1 at 12, is currently listed as counsel of record, but she has moved to withdraw because her "employment with Gabriel Law Firm, P.C. ended in September 2023" and "because the plaintiffs are represented by other counsels in this action," namely Suren Gabriel and Ankesh Sharma of Gabriel Law Firm, P.C., as to Plaintiffs Norma Acevedo De Nunez, Crystal Cruz, and Rafael Cruz, and Jason Arthur Greenberg of Law Offices of Jason A. Greenberg, P.C., as to Plaintiff Victor M. Nunez. ECF No. 10 at 2-7. George David Silva, as opposed to Jason A. Greenberg, has now appeared as counsel for Plaintiff Victor M. Nunez. See generally ECF No. 11 . Despite Ms. Andreou's representation that Plaintiffs Norma Acevedo De Nunez, Crystal Cruz, and Rafael Cruz are represented by other counsel at her prior firm, no such appearance has been made on their behalf. Further, current counsel for Plaintiff Victor M. Nunez, George David Silva, referred to Defendants' counsel as Marguerite Peck, who is not listed as counsel of record for Defendants and should appear on their behalf if she is representing Defendants in this action.
Given that this is the second adjournment of the initial conference and related deadlines to enable the attorneys to resolve the aforementioned issues, see generally ECF Nos. 9 & 12; see 4/17/2024 Order, no further adjournments based on these issues should be expected.
