Minute Order _ Status Conference
Minutes and Order: The Court held a status conference by Zoom to discuss the status of discovery. Benjamin P. Pfouts and Patrick J. Peroti appeared on behalf of Plaintiffs. Daran P. Kiefer appeared on behalf of Defendant Kreiner & Peters Co. Wesley E. Stockard, Simon J. Torres, and Rachel Kaercher appeared on behalf of Swagelok Company, UnitedHealth Group, Inc., United Healthcare Services, Inc., UnitedHealthcare Insurance Company, and Optum Inc. Plaintiffs provided an update on discovery with respect to Defendant Kreiner & Peters. Specifically, Plaintiffs claim that Kreiner & Peters is withholding certain discovery and not producing a witness for deposition based on a claim of privilege. Based on discussion with counsel, the Court ORDERS Plaintiffs to file a notice on the docket by July 6, 2026 identifying, without argument or explanation, the information sought from Kreiner & Peters withheld. Further, the Court ORDERS Plaintiffs and Kreiner & Peters each to file a briefnot to exceed 10 pagesoutlining their respective positions on what is and is not privileged and why. As to the discovery directed at the remaining Defendants, Plaintiffs reported that, despite counsel's best efforts, the parties have reached an impasse on various issues, including the availability of class discovery. Based on discussion with counsel, the Court took the matter under advisement and committed to reviewing the record and resolving the dispute on class discovery as soon as practicable. In doing so, the Court will address the case schedule and make any amendments to the current deadlines as necessary. Judge J. Philip Calabrese on June 30. 2026. Time: 45 minutes. (Y,A).
