CLERK'S JUDGMENT dismissing case. (dnb)--Please refer to http://www.ca11.uscourts.gov to obtain an appeals jurisdiction checklist--
Order on Motion for Summary Judgment Order on Motion to Strike Order on Motion for Leave to File
ORDER. The Court GRANTS Jocelyn and Paul Melvin's Motion to Supplement the Record 68 , GRANTS in PART Allstate's Motion to Strike 59 , and GRANTS Allstates Motion for Summary Judgment 54 only as it relates to Allstate's duty to defend Jocelyn and Paul Melvin in the Underlying Lawsuit, and DENIES the Motion as it relates to Allstates duty to indemnify because the Court lacks subject matter jurisdiction to decide that issue. Thus, the Court DECLARES that Allstate does not have to provide a defense to Jocelyn or Paul Melvin under either the Family Liability Protection Coverage X or the Guest Medical Protection Coverage Y of the Rental Policy for the claims arising out of the May 11, 2021 incident described herein. As there are no additional issues for this Court to decide, the Clerk is directed to close this case. Signed by Judge Victoria M. Calvert on 3/21/2024. (dnb)
