Order Regarding 109 Response to Order to Show Cause. After over two months and multiple requests for extensions, Plaintiff's counsel has failed to fully comply with the Order to Show Cause. See ECF Nos. 66, 95. Plaintiff's counsel, Mr. Shahian, is ordered to cure his non-compliance by filing a supplemental declaration by July 10, 2026, by addressing the following deficiencies:
(1) Mr. Shahian was specifically ordered to file a chart that includes "all instances in the last five years of when a court, either state or federal, sanctioned any attorney for conduct that occurred during the time that attorney worked for SLP." ECF No. 95 at 1; see also ECF No. 66 at 8. This encompasses all instances of sanctions regardless of whether the sanction amount is over $1,000. Mr. Shahian must include in his chart all instances of sanctions by SLP attorneys in the last five years.
(2) Further, Mr. Shahian must include all instances of sanctions imposed against any attorney, not only sanctions imposed against the firm.
(3) The Court ordered that Mr. Shahian's chart "shall necessarily include all the sanctions already included by the SLP attorneys in the declarations provided to the Court in response to the Continued OSC. Mr. Shahian shall not incorporate those declarations by reference or rely solely on those declarations in preparing his declaration." ECF No. 66 at 8-9. Mr. Shahian did not include all of the prior instances of sanctions that his current and former colleagues submitted to the Court. Mr. Shahian must include those previously submitted instances of sanctions in "a single, comprehensive chart." Id.
In addition to curing the above deficiencies, the Court ORDERS Mr. Shahian to include in his supplemental declaration the total number of pending cases SLP managed as of May 6, 2026.
