Stipulation and Order of Dismissal
STIPULATION OF DISMISSAL WITH PREJUDICE: IT IS HEREBY STIPULATED AND AGREED, by and between Plaintiff Robert Venditti (the "Plaintiff"), Defendants Christian Brothers Institute, Peter Zawot, and Edward Bergeron (collectively, the "Defendants") in the above-captioned action, through their undersigned counsel that, whereas no party hereto is an infant or incompetent person for whom a committee has been appointed, and no person not a party has an interest in the subject matter of the action, in accordance with Rule 41(a)(2) of the Federal Rules of Civil Procedure, the Amended Complaint in the above-captioned action and all claims alleged therein be dismissed with prejudice, with each party to bear their own fees and costs, except that this Court shall retain jurisdiction to interpret and enforce the Settlement Agreement and General Release Agreement, dated June 23, 2026. IT IS FURTHER STIPULATED AND AGREED that this Stipulation may be executed in counterparts with scanned PDF and/or facsimile signatures treated as originals. SO ORDERED. DECISION AND ORDER: For the reasons set forth above, the Court finds the proposed settlement to be fair and reasonable. The Proposed Settlement Agreement as filed at ECF No. 39 is APPROVED and the motion to approve the settlement is GRANTED. The tota l settlement amount is $110,000: Plaintiff's counsel is to receive $36,166.35 in attorneys' fees and $405 in costs, and Plaintiff is to receive the balance, $73,428.65. Having approved the Proposed Settlement Agreement a nd granted the motion to approve the settlement, the Court also will sign and separately docket the parties' proposed Stipulation of Dismissal With Prejudice, which was attached as Exhibit A to the Proposed Settlement Agreement, see ECF No. 39 a t 12-13, with a minor edit to reflect the date of the revised final settlement agreement that was approved by the Court.
