On December 29, 2025, Defendant Jonathan Larmore filed a limited objection (Doc. 458 ) to the Receiver's Motion for an Order (I) Establishing Bar Date for Filing of Proofs of Claim Against the Receivership Estates; (II) Authorizing the Retention of Omni Agent Solutions, Inc., as Claims and Noticing Agent; (III) Approving Claim Form and Notice Procedures; and (IV) Granting Related Relief (Doc. 451 ). In its reply, the Receiver states that he and counsel for Mr. Larmore "have been in contact to address issues raised and anticipate that a consensual resolution can be achieved," and would update the Court accordingly. (Doc. 460 .) The Court has not received an update. It therefore is ordered that, by no later than September 25, 2026, the Receiver and counsel for Mr. Larmore jointly notify the Court whether a resolution of Mr. Larmore's limited objection has been achieved.Signed by Senior Judge Douglas L Rayes on 9/22/2026. Order ~Util - Terminate Motions ~Util - Set/Reset Deadlines/Hearings
ORDER that the Motion 370 is GRANTED as set forth in this Order. Any and all objections to the Motion concerning the Bidding Procedures and relief granted in this Order that have not been withdrawn, waived, resolved, sustained, or settled, are expressly denied and overruled in their entirety. The Bidding Procedures, as set forth in Exhibit A to this Order are approved in their entirety. The Receiver may proceed to sell Village Brewhouse, in accordance with the Bidding Procedures. The Receiver may proceed to sell Village Brewhouse free and clear of liens, claims, encumbrances, and other interests at a public online auction to be held on the Real Insight Marketplace platform in accordance with and subject to the Bidding Procedures on November 18, 2026, at 12:00 Noon (Eastern Time). The Sale Hearing shall be held in Courtroom 606 at the United States District Court for the District of Arizona, Sandra Day O'Connor U.S. Courthouse 401 W. Washington St., Suite 130, SPC 1, Phoenix, Arizona 85003-2118, on December 1, 2026, at 2:30 p.m. (Phoenix Time). Any objection on any basis to the proposed sale of Village Brewhouse must be filed in writing with the Court no later than November 23, 2026 at 5:00 p.m. (Phoenix Time) (the Objection Deadline) and served on counsel to the Receiver, Smith, Gambrell & Russell, LLP, Attn: Allen G. Kadish and Harrison H.D. Breakstone, 1301 Avenue of the Americas, New York, New York 10019. This Order shall become effective immediately upon its entry. This Court shall retain jurisdiction over any and all matters or disputes arising from or related to this Order or its enforcement. See document for further details.
