Status Conference
Minutes and Orders. Status Conference re 9/25/2026 Mandatory Settlement Conference ("MSC") for all consolidated cases held on 9/10/2026. The Court will permit the following parties to appear remotely for the MSC: Plaintiffs Christina Fischer, Andrea Hayward, and Theresa Landt, and Defendant Kim Buhler. All counsel and all other parties must appear in-person.
Counsel for the remote parties are responsible for providing a hotspot wifi connection for their clients, as well as devices to enable their full video and audio participation. The Court is unable to provide any wifi service. Counsel must create and establish the necessary Zoom/Teams video conference-connection. Defendant Angela Hong's personal appearance is excused, but she must remain telephonically available throughout the MSC, including language translation service to be arranged by her counsel.
Settlement briefs may not exceed twenty pages. Counsel and all parties must report to Courtroom 2B in the Schwartz Federal Courthouse, and be ready to begin promptly by 9 AM, including all Zoom connections. In Chambers Conference ~Util - Set Hearings
Minutes and Order Setting Informal Discovery Conference ("IDC"). Discovery Intake Call held on 9/10/2026 re: 1) Hortman parties' deposition of Plaintiff George Landt, including a disputed written agreement and objections raised during the deposition; and 2) Plaintiffs' deposition of Kim Buhler, including document production for the deposition and individual tax returns.
The parties must complete meet and confer efforts consistent with Judge Butcher's chambers rules. Each side must send a maximum three-page letter brief (14-pt font) summarizing any remaining issues concerning its noticed deposition to efile_Butcher@casd.uscourts.gov (copying opposing counsel) by close of business on 9/17/2026. Counsel must attach relevant, highlighted portions of the deposition transcript, which do not count toward the page limitation.
Letter briefs in opposition, subject to the same parameters and conditions, are due by close of business on 9/22/2026.
Zoom IDC (audio-only) is set for 9/24/2026 at 10:00 AM before Magistrate Judge Daniel E. Butcher. The Court will email counsel Zoom audio-only connection information prior to the Conference.
