   Before the Court is the Joint Discovery Plan and Scheduling Order (ECF No. 12 ) through which the parties seek an initial year long discovery period based on counsel's trial schedule. While the Court sympathizes with a busy trial schedule, this does not support good cause for such an initial one year discovery period that will undoubtedly lead to delay and the failure to act promptly to serve written and conduct oral discovery as contemplated by Rule 26.

   Accordingly, IT IS HEREBY ORDERED that the Joint Discovery Plan and Scheduling Order (ECF No. 12 ) is DENIED without prejudice.

   IT IS FURTHER ORDERED that the parties must submit a discovery plan measuring discovery 180 days from the date of this Order. Extensions will be granted so long as the parties actively pursue discovery during the initial discovery period.
