OPINION AND ORDER. Defendant CMD's Omnibus Motion [ECF 10 ] is GRANTED IN PART and DENIED IN PART. CMD's motion to dismiss for failure to state a claim is DENIED. CMD's motion to dismiss for lack of personal jurisdiction is GRANTED as to Counts I (Fraud); II (Fraud); and V (Unfair Business Practices). These counts are DISMISSED WITHOUT PREJUDICE. CMD's motion to dismiss for lack of personal jurisdiction is DENIED as to the remaining counts. CMD's motion to transfer is DENIED. Sterling's motion for default judgment against CMD, to Strike CMD's Answer as untimely, and to disqualify Burton Law Firm PLLC [ECF 11 ] is DENIED. CMD's motion to strike Sterling's motion for default [ECF 17 ] is DENIED AS MOOT. The parties are ORDERED to file their Joint Preliminary Report and Discovery Plan within 14 days of this Order.
