MINUTE ORDER issued on 7/23/2026 by the Courtroom Deputy for District Judge Dena M. Coggins: On 7/22/2026, Defendant Brian M. Pierce filed a 36 Motion for Summary Judgment, but that Motion does not comply with the meet and confer requirement in the court's [25-1] Standing Order, which states: "Prior to filing a motion in a case in which the parties are represented by counsel, counsel shall meet and confer to meaningfully discuss the substance of the contemplated motion and potential resolution. Counsel should resolve minor procedural or other non-substantive matters prior to filing the motion. The briefing on motions should be directed to substantive issues requiring resolution by the court. A notice of motion shall contain a certification by counsel filing the motion that meet and confer efforts have been exhausted, with a brief summary of the parties' meet and confer efforts." (See Doc. No. 25-1 at 2.) Defendant Pierce's Notice of Motion does not include the required certification. Accordingly, Defendant Pierce's 36 Motion is hereby DENIED, without prejudice to Defendant Pierce filing a Motion after meaningfully meeting and conferring with Defendant and Cross Claimant Kelli O. Joel. In addition, despite the court's 31 referral of this case to the Voluntary Dispute Resolution Program ("VDRP") on 8/19/2025, the parties did not actually participate in that program. As indicated in the parties' 35 Joint Status Report, it is clear that not all parties wish to participate in the program, which is voluntary. This case will therefore proceed. Accordingly, by no later than 8/21/2026, the parties shall file an Updated Joint Status Report regarding scheduling in compliance with the court's 25 initial case management Order.
