Order
ORDER: The Court has reviewed the parties' proposed schedule set forth in the Joint Status Report and Proposed Discovery Plan, ECF No. 97 . Defendants shall serve their responses to Plaintiffs' first discovery requests concerning choice of law by September 4, 2026. Any Rule 30(b)(6) depositions concerning choice of law shall be completed by September 25, 2026. Plaintiffs shall respond to Defendants' Motion to Determine Choice of Law, ECF No. 91 , by October 19, 2026. Defendants shall file any reply by October 26, 2026. The Court will set oral argument by separate notice. The expert disclosure deadlines remain STAYED until the Court resolves Defendants' motion. Plaintiffs' initial expert disclosures are due 15 days after that decision, Defendants' initial expert disclosures are due 15 days after Plaintiffs' disclosures, and Plaintiffs' rebuttal expert disclosures are due 15 days after Defendants' disclosures. Because the proposed January 4, 2027, discovery cutoff may not allow sufficient time for expert discovery, the Court declines to adopt the parties' remaining proposed modifications at this time. The existing deadlines for non-expert discovery remain in effect. The December 11, 2026, deadlines for Daubert motions, the Notice of To-Be-Adjudicated Claims and Affirmative Defenses, dispositive motions, and motions for certification of state law questions are STAYED pending further order. Within seven days after the Court's decision on Defendants' motion, the parties shall jointly propose an expert discovery cutoff, a deadline for motions to compel concerning expert discovery, and replacement dates for the stayed deadlines. If the parties cannot agree, they shall separately state their proposed dates. All other deadlines in the Jury Trial Scheduling Order remain in effect. Text-only; no PDF. Signed by Judge Mary K. Dimke. (ETG)
