Order/Notice to Attorney
(Text-Only) ORDER. In the 150 cases identified for trial pursuant to Docket Number 2549 , the only objection that can be made during a deposition is "objection form." There will be no speaking objections. If the individual plaintiff's counsel believes that a particular treating physician's deposition is beyond the scope of permissible discovery, then counsel must seek a protective order prior to the deposition. If, during the course of a deposition, plaintiff's counsel believes that the examination of the treating provider has exceeded the scope of the plaintiff's waiver of his or her medical privilege, counsel may instruct the physician not to answer the question, terminate the deposition, and request a protective order from the Court. All counsel are warned that the Court will consider an award of costs and fees to the prevailing party to such a motion. Ordered by Magistrate Judge David T. Schultz on 7/15/2026. (SB)
