Order To Show Cause
ORDER TO SHOW CAUSE - This matter is before the Court on the motion of Plaintiffs' counsel seeking to withdraw their appearances on behalf of Plaintiff John Doe 7. [Dkt. 131 .] The Court scheduled that motion for a hearing on April 18, 2023 and ordered as follows: "Plaintiff John Doe 7 is ordered to appear in person along with at least one of Plaintiffs' attorneys." [Dkt. 134 at 1 (emphasis in original).] Plaintiffs' attorneys appeared for the hearing. John Doe 7 did not. Accordingly, John Doe 7 shall appear in person, with his counsel of record, in Courtroom 270, United States Courthouse, 46 East Ohio Street, Indianapolis, Indiana, on Friday, May 3, 2024, at 1:00 p.m. (Eastern), before Magistrate Judge Mark J. Dinsmore, to show cause why he should not be sanctioned for his failure to comply with the Court's order requiring his attendance at the April 18, 2024 hearing. The failure of John Doe 7 to appear will result in a recommendation that John Doe 7's claims in this case be dismissed, with prejudice, for his failure to comply with the orders of the Court. Plaintiffs' counsel shall serve this Order on John Doe 7 both electronically (if possible) and by United States mail, and shall file a Notice that they have done so on or before April 24, 2024. Signed by Magistrate Judge Mark J. Dinsmore on 4/18/2024. (DWH) (Entered: 04/18/2024)
