MINUTE entry before the Honorable Young B. Kim: On April 20, 2026, the court ordered Defendant to respond to Plaintiff's settlement demand by May 1, 2026. (R. 52.) Defendant failed to meet this deadline, informing the court and Plaintiff via email on the deadline date that it was still working on a response and would provide one "early next week." While the court appreciates the update, the proper practice is to seek a formal extension---either by email or motion for good cause---rather than treating a court-ordered deadline as a suggestion. Furthermore, when a deadline cannot be met, a litigant should, at a minimum, propose a definite new date rather than an ambiguous timeframe like "early next week." MINUTE entry before the Honorable Young B. Kim: Preliminary settlement discussion held. A Webex settlement conference is scheduled for June 12, 2026, at 10:00 a.m. The court will email a video link prior to the start of the conference with instructions to join the meeting. Parties are to notify the court by noon on April 21, 2026, if any of the individuals who are required to appear for the conference has a scheduling conflict. If so, the court will reschedule the conference for July 20 or June 18, 2026. Parties are ordered to review and follow the court's standing order on "Settlement Conferences" on its webpage. The individuals with the authority to settle this matter must be present by video for the entire conference. Defendant to respond to Plaintiff's settlement demand with a settlement offer by May 1, 2026. When doing so, Defendant must include the court in its email. Plaintiff to then email a settlement position statement to Defendant, with a copy to the court, by May 18, 2026, including a revised settlement demand. Defendant to respond in writing, with a copy to the court, by June 1, 2026, including a revised settlement offer. Defendant must also email a draft settlement and release to Plaintiff along with its position statement so that Plaintiff is advised of the collateral terms Defendant requires to resolve this matter. Parties are to discuss their expert reports and attach them to the settlement position statements as exhibits. These settlement position statements are not to be filed with the clerk's office.
