PAPERLESS ORDER denying as moot Non-Party ER Distribution, Inc.'s 462 Emergency Motion to Intervene for Limited Purpose, to Quash Bank of America Subpoena, and/or for Protective Order Preserving Status Quo (the "Motion"). The Non-Party seeks a Court order "granting Movants leave to intervene for the limited purpose of challenging the Bank of America subpoena." Mot. at 3. "The subpoenaed records are being sought for use in connection with a contempt hearing against Alex Santiesteban[.]" Mot. at 2. The contempt hearing against Defendant Santiesteban was cancelled pursuant to the Court's June 15, 2026, Order, ECF No. 489 . "Because there is no pending proceeding in which the discovery sought can be used, the validity of the subpoena presents no live case or controversy." Sheridan Ross P.C. v. Fla. Power & Light Co., No. 13-80229-CIV, 2013 U.S. Dist. LEXIS 31664, at *1 (S.D. Fla. Mar. 7, 2013). Therefore, it is ORDERED AND ADJUDGED that the instant Motion is DENIED AS MOOT.
