Order Dismissing Case
SECOND AMENDED STIPULATION OF DISMISSAL AND ORDER RE 327 . The parties amended their Settlement Agreement, and entered into an Amended Stipulation of Dismissal (Dkt. No. 324), which provided that this action was dismissed with prejudice, subject to re-filing with out prejudice within three years of the Effective Date, pursuant to Rule 41 (a)(1)(A)(ii) of the Fed.R.Civ. Pr., which the Court converted that Stipulation to an Order of the Court dated November 18, 2024, and filed on November 19, 2024 (Dkt. No. 326); and WHEREAS, the parties desire to further extend the time limit for re-filing without prejudice; IT IS STIPULATED AND AGREED by and between the parties in this action, by and through their undersigned counsel, this action, including all claims, counter-claims, cross-claims and third-party claims, is still dismissed, with prejudice, but is subject to re-filing without prejudice on or before January 8, 2027, pursuant to Rule 41(a)(1)(A)(ii) of the Fed.R.Civ.Pr., and the parties also request that the Court convert this Stipulation to an Order of the Court.
