CIVIL CASE MANAGEMENT PLAN AND SCHEDULING ORDER: All parties do not consent to conducting all further proceedings before a Magistrate Judge, including motions and trial. 28 U.S.C. § 636(c). This case is not to be tried to a jury. Fact Discovery due by 8/21/2027. If the Court grants conditional certification, the parties agree on the necessity of further class and collective discover, but disagree on the scope. The Parties will meet and confer on this issue prior to seeking court intervention. Depositions to be completed by the fact discovery deadline. All expert discovery shall be completed no later than 45 days after the fact discovery deadline. Plaintiffs anticipate that they will file a motion for conditional certification of a collective and class notice under FLSA 216 by November 5, 2026. Plaintiff anticipate that they will file a motion for class certification under Rule 23 no later than 90 days prior to the end of fact discovery. In the event conditional certification is granted, Defendants will likely file a motion for decertification of the conditional collective, after the close of discovery. Defendants anticipate taking discovery of collective and class members. The Parties will meet and confer on the scope of collective and class discovery. Motions due by 11/5/2026.
