As to all claims outside Jan uary 2016 to June 2020 at Old Vineyard, and those claims are DISMISSED. As to all claims under the FCA and NCFCA relating to false Medicaid and Tricare claims, and those claims are DISMISSED WITHOUT PREJUDICE. As to all claims under the FCA and NCFCA relating to IOP services allegedly billed to Medicare, and those claims are DISMISSED. As to all claims under the FCA and NCFCA stemming from alleged (1) improper and excessive stays, (2) improper nursing assessments, (3) missing documentation in the outpatient unit and missing admission orders, and (4) alleged emails, and those claims are DISMISSED.
