MINUTE entry before the Honorable M. David Weisman: Magistrate Status hearing held. Discussion held on possible discovery that can proceed while merits-based motions are pending before the district court. Plaintiff does not believe that discovery is closed, and notes that additional discovery may be pursued if the matters before the district court do not resolve the matter. Defendants seek to freeze the record as it relates to the pending motions before the District Court. Defendants indicate they are concerned about being "ambushed." The Court stays discovery pending a ruling on the merits-based motions. Defendants' proposal to conduct discovery regarding cost-shifting/allocation and the NAV back-office expenses is denied as premature given that it relates to damages and the nominal amount such discovery might progress the case is not worth the potential effort involved. Status hearing set for 7/22/26 at 9:15 a.m. for docket management.
