MINUTE ORDER by Judge John D Russell : After reviewing the documents produced by Ms. Hurst for in camera review, the Court finds that the documents (Bates Nos. Dowart [sic] Subpoena 0001-0150) are subject to production. Ms. Goff implicitly waived the privilege ordinarily applicable to these documents when she claimed Ms. Hurst failed to communicate regarding dispositive motions and responses. She also affirmatively waived the attorney-client privilege with respect to these documents. See Dkts. 114 , 116 . Accordingly, the Court orders that the documents be produced pursuant to BOKF's subpoena. Dkt. 122 . With the exception of Bates Nos. Dowart Subpoena 0008-0026, the parties are directed to designate the produced documents as "Highly Confidential," to utilize the protections afforded to Highly Confidential documents under the applicable protective order, Dkt. 16 , and to use the produced documents solely in connection with the July 8 evidentiary hearing and for no other purpose.
