1 - Terminate Motion Deadlines/Hearings (inc F&R) Order on Motion to Dismiss/Lack of Prosecution
EO: ORDER INFORMING THE PARTIES OF THIS COURT'S RULINGS REGARDING PLAINTIFF'S PROPOSED AMENDED COMPLAINT AND DEFENDANT'S MOTION TO DISMISS FOR FAILURE TO PROSECUTE
  On May 22, 2026, Defendant Honolulu Police Department ("Defendant") filed a Motion to Dismiss for Failure to Prosecute ("5/22 Motion"). [Dkt. no. 20.] Plaintiff Rene Ramathal ("Plaintiff") failed to file a response to the 5/22 Motion and instead filed a document titled "Amended Complaint for Violation of Civil Rights," [filed 6/29/26 (dkt. no. 23)]. On July 2, 2026, this Court issued an entering order addressing Plaintiff's filing ("7/2 EO"). [Dkt. no. 25.]
  Among other things, the 7/2 EO: construed docket number 23 as Plaintiff's proposed amended complaint; ordered Plaintiff to file a motion seeking leave to file the proposed amended complaint ("Motion for Leave"); and cautioned Plaintiff that, if he failed to file a timely Motion for Leave, the proposed amended complaint would be stricken and Defendant's 5/22 Motion would be granted. See 7/2 EO at PageID.114. Plaintiff's deadline to file the Motion for Leave was July 16, 2026, and Plaintiff was instructed that, if he was unable to meet that deadline, he was to file a motion for an extension before July 16, 2026. See id.
  As of the date of this entering order, Plaintiff has neither filed a Motion for Leave nor filed a motion for an extension of the filing deadline. Based on the foregoing, the parties are INFORMED that, pursuant to the 7/2 EO, Plaintiff's proposed amended complaint is STRICKEN, and Defendant's 5/22 Motion is GRANTED. A written order will follow that will supersede these rulings. If any party wishes to file a motion for reconsideration, that party must wait until the written order is filed to do so.
  IT IS SO ORDERED.
